If your Business is going to be in a city or town centre then it is possible that you probably fall under the smoke control legislation. If yo do not yo may find that the building inspector or environmental health inspector will insist that you only install an oven that is exempt.
It has taken me more than 18 months and quite literally tens of thousands of pounds to get clarification on how the law may apply to wood burning Pizza ovens. The clean air act says in brief that it is an offence to emit smoke from the chimney of a building or to use an un licenced fuel in an un exempt appliance.
Early discussions with defra excluded wood burning pizza ovens in the garden as it was felt that wood burning ovens would fall under the same legislation as a bbq or a chimenea and as a result you could only be prosecuted for creating a nusciance to your neighbours ie smoking them out. commercial premises however are not exempt of this rule.
It is quite clear that a bbq or a chimenea can not be called a building, but an oven on the other hand has a chimney and when built in could be considered a building and as a result quite clearly could fall under the clean air regulations .
Early in 2009 one of my customers built one of our ovens into a housing in his garden, the neighbours were an unappreciative bunch and complained to the local environmental officer who deemed the oven to be non compliant and he was offered the choice of removing the oven with a warning or face a 1000 pound fine each time he used it.
As a result of this injustice I deemed to put all of our ovens through the smoke control testing thinking that it would cost a couple of thousand pounds and take a couple of months . I was mistaken and it seems that as the first person to put wood burning ovens through the tests defra now have to re write the rule book but after getting my local MP involved I am happy top say that from the 6th of April 2011 the Dingley dell range of commercial and domestic ovens will be on the statute as the only uk made wood burning ovens that have this exemption and 1 of only 3 manufacturers world wide.
Over the last year I have seen many ovens on sale claiming to have exemption under some european certification some of these companies are quite large organisations so Please beware these ovens are not exempt and with more people wanting to have wood fired ovens in their gardens the regulations will just get enforced more and more stringently .

I have spoken to so many people that have tried to build their own oven from scratch and who have admitted that it cost more than one of ours and took much longer to build than they thought it would but worst of all they are illegal and they could face prosecution for using it.
